History of Khagrachari Judiciary:
Khagrachari district was born in 1983. However, naming, demarcation and mapping took several more days. This hill district was given a separate name on 25th February 1985. The foundation stone of Khagrachari Judge Court was laid in 1993 AD. The foundation stone was laid by the then Deputy Commissioner Mr. Air Mohammad.
As history bears witness, the Regulation of 1900 was amended by the Chittagong Hill Tracts (Amendment) Regulation, 1910 and the post of Superintendent was changed to Deputy Commissioner and Assistant Superintendent to Deputy Magistrate and Deputy Collector. In the administrative system of dual governance, Chittagong Territory is reserved as an Excluded Area under the exclusive responsibility of the Governor with the help of the Executive Council.
Its operation as a new district began in 1983 AD, but the Civil Procedure Act of 1908 AD was not directly applicable to the hill districts. Rule 6 of the Chittagong Hill Tracts Rules made in accordance with Section 18 of the Chittagong Hill Tracts Regulation 1900 states that in the case of issuance or execution of process in civil cases or in the case of commission or decree Tamilization, the concerned judge should take action as per the Civil Procedure Code as far as possible. Accordingly, the District Commissioner was an ex-officio Civil Judge (equivalent to a Joint District Judge). The orders of the District Commissioner were appealable to the Chittagong Divisional Commissioner under Rule 10 of the Regulation. However, criminal procedure, penal code and evidence law were being applied as usual in the criminal courts as in the plain districts. An Additional Divisional Commissioner, on behalf of the Divisional Commissioner, conducted the proceedings of the Sessions Court. But he himself could exercise powers as Additional Sessions Judge. The government made the above amendment through gazette notification as per clause 1(2) of Act No. 38 of 2003, but we have to wait for it for a few more years. Later in 2006, following the filing of Writ Petition-606/2006 in the Hon'ble High Court Division for the implementation of Section 26 of Act No. 38 of 2003 and Act No. 8 of 2000, the Hon'ble High Court absolute the rule in February 2008. In the meantime, Mr. Nitai Chandra Saha took charge as the Acting Chief Judicial Magistrate on 1st November 2007 through the separation of judicial department in 2007 and on 1st July 2008 Judiciary was started in Khagrachari district. At that time, the first Mr. Mokhtar Ahmed served as First District and Sessions Judge. Since then, the learned judges of Khagrachari Judiciary and Judicial Magistrate have been relentlessly conducting judicial activities to establish justice and keep the doors of service open and upholding the justice of the people seeking justice to ensure justice for the vast majority of people in the Khagrachari hill region.
